CA Judge: Thieves Not Required To Pay For Stolen Medical Marijuana

In another important case out of California, a Sonoma County Judge has ruled that four men who stole 32 marijuana plants belonging to two authorized medical cannabis patient do not need to reimburse the victims.

The indecent occurred in October of 2009, four men approached the home of Michael Steffen dressed as police officers and proceeded to rob him at gunpoint. Along with the marijuana, the thieves also loaded up a trailer with other goods from the home while Steffen was bound. In court the four offenders were forced to pay restitution for those other items, in addition to Steffen’s medical costs resulting from the break in.

The judge in the case noted that the circumstances around the grow were a major reason for the money not being awarded in regards to the marijuana, he said,

“I don’t believe they’ve met the burden … that this was a legal grow. It does appear to have been a commercial enterprise.”[Press Democrat]

In the event the grower was able to prove how much marijuana he was producing, in accordance with state and local law, this case could have gone very different. For all we know Mr. Steffen, who claimed to have 50 pounds to police at the time, was mistaken and actually producing appropriately for his mother and self to medicate in an affordable fashion. This shows why patients growing should keep modest current records, if anything to show you are following local law. Had Steffen been able to produce anything at all he may of been compensated.
