For a moment I thought this was another whack Facebook virus trick or something but, indeed, it seems to be true. Police Commissioner Ray Kelly has instructed the NYPD to halt arrests of people found with marijuana that may have been discovered through intrusive means.
The memo which is dated September 19th, now instructs officers to ticket and fine civilians found with small amounts of marijuana on their person. As the law intended, a misdemeanor charge was only to be enforced if the police happen upon a civilian who has marijuana in public view.
As most New York Blacks and Latinos will tell you, having your pockets shaken out by NYPD for no reason is about as common as seeing celebrities and models dashing along Fashion Avenue.
To support a charge, the public display of marihuana must be an activity undertaken of the subject’s own volition. Thus, uniformed members of the service lawfully exercising their police powers during a stop may not charge the individual with [public display] if the marihuana recovered was disclosed to public view at an officer’s discretion.
I’m sure this information is causing a collective exhaling across the Greenie stratosphere. There is rumor of a new bill that will be introduced to legislation that seeks to decriminalize possession of small amount of marijuana. We have to keep up the heat if we hope to continue to make strides in this battle. If we can bend the hand of the NYPD then we can take on the world, right? Right!!!
