Washington Adopts “Open Container” Law for Cannabis


Many states are starting to treat cannabis like alcohol. For alcohol, in most places, the law is “no open containers in a moving vehicle.” This should not come as a surprise.


Recent legislation in Washington limits how one may possess marijuana while in a moving vehicle.

Section 8 of House Bill 1276 establishes a so-called “open container law for marijuana.”

The statute defines any consumption of marijuana while in a moving vehicle as a traffic violation. The statute further requires that any cannabis possessed in a moving vehicle must be located in a sealed container in either the trunk, glove compartment, or some other area that is inaccessible to the driver or passengers. Failure to do so will be defined as a traffic violation.
